CARIBBEAN SUN HEARING NOW SET FOR FRIDAY

Dec. 18, 2003 – A court hearing on whether Caribbean Sun Airlines will be allowed to continue operating in the territory has been rescheduled for Friday, Tom Bolt, the carrier's attorney, said on Wednesday, the day on which it was originally to have taken place.
The airline has been providing service in the territory this week with the permission of District Judge Thomas K. Moore, who on Dec. 11 issued a temporary restraining order against government efforts to deny the carrier approval because of its name. The order is in effect until the hearing now set for Friday.
Caribbean Sun went to court seeking a permanent injunction against enforcement of the government's decision to refuse to register the company to operate in the territory. Moore granted a 10-day continuance of the case at the request of Assistant Attorney General Kerry Drue, who told him the V.I. Justice Department had had only half an hour's notice on Dec. 11 to prepare a rebuttal to the airline's request for an injunction.
Lt. Gov. Vargrave Richards, backed by an opinion by Attorney General Iver Stridiron, refused to register the airline as a business operating in the territory on the grounds that its name is too similar to those of two other businesses — Sun Airways and Caribbean Airline Acquisitions. Stridiron said on Wednesday that the airline has been operating in the territory this week under Moore's 10-day reprieve.
