Accused AK-47 Killer Re-Arrested In Jail

Police say gunning down Dion Henry with an AK-47 assault rifle in Anna’s Fancy on the morning of April 8 was not where 28-year-old Jody Penn began his violent spree.
On Monday authorities re-arrested Penn—who was already indefinitely detained by the Bureau of Corrections awaiting trial for first-degree murder—saying he also shot up a moving vehicle in the same neighborhood two days before the Henry murder, wounding a man and a woman in the car.
Penn was charged with two additional counts of first-degree assault to stack onto his already hefty charges of murder, assault and possession of illegal weapons.
On April 9, Superior Court Judge Michael Dunston said Penn posed a serious threat to the community and was a flight risk, ordering Penn held on $200,000 cash bail, which he has not been able to pay.
Judge Brenda Hollar, who presided over Penn’s April 15 arraignment, did not change the terms of bail and said the case would still be tried by Dunston sometime this summer. A separate bail hearing will be conducted May 13, and any plea agreements have to be submitted by May 21, she said.
Dunston will set the date for a jury trial.
