Governor Proposes Legislative Amendments to Reform USVI Sentencing Laws

In a move towards a more balanced justice system, Gov. Albert Bryan Jr. has submitted proposed legislative amendments to the 35th Legislature, aimed at reforming sentencing laws for certain offenses in the U.S. Virgin Islands. These changes address mandatory minimum sentencing requirements that currently exist under Titles 14 and 23 of the Virgin Islands Code.

The proposed legislation seeks to strike Title 14, section 2254 and amend Title 23, section 481, which currently mandate minimum sentences for specific weapons offenses. Recognizing the need to combat unlawful gun possession and gun violence while promoting rehabilitation, the amendments would allow individuals convicted of these crimes to accrue “good time” and be considered for parole, reflecting their progress and behavior.

Furthermore, the governor proposes significant changes to Title 14, section 923, which mandates a life sentence without the possibility of parole for those convicted of first-degree murder. The new legislation would replace this with a discretionary range of sentences from 25 years to life without parole, depending on the circumstances surrounding each case. This adjustment provides the courts with the flexibility to impose sentences that more accurately reflect the nuances of each case.

Bryan said, “While we remain steadfast in our commitment to uphold public safety, we must also ensure that our justice system is fair and considers the potential for rehabilitation. These amendments will help balance the scales of justice by allowing for sentencing that truly considers the individual circumstances of each case.”

Bryan thanks Senate President Francis Jr. and all members of the Legislature for their consideration of these crucial reforms, emphasizing that this legislation is a step towards achieving a justice system that prioritizes both accountability and the opportunity for redemption.

The Bryan administration urges the Legislature to review and pass these amendments promptly to help foster a justice system that is not only tough on crime but also supportive of constructive rehabilitation and reintegration into society.
