NOTICE OF MARSHAL’S SALE 

     On August 1, 2024 at 10 a.m. the following vessel will be sold at a public auction sale pursuant to a Default Judgment and an Order granting Defendants’ Expedited Motion for Sale of the White Motor Vessel VI-2887-TC issued by the U.S. District Court of the Virgin Islands on June 25, 2024 (Dkt Nos. 112 & 113) and pursuant to Local Admiralty Rule E.12 and Supplemental Rule E.9. The sale will take place at the Office of the United States Marshal, Ron de Lugo Federal Building, 5500 Veterans Drive, St. Thomas, VI 00802: the M/V “Sky’s the Limit” a/k/a the White Motor Vessel, a 40-foot Wellcraft Portofino last registered with the Virgin Islands Department of Planning and Natural Resources as VI-2887-TC, along with her engine, tackle, rigging, apparel, and appurtenances (collectively, the “White Motor Vessel”).
     Defendants and Third-Party Plaintiffs S/V ‘MEOW’, Tim Ashe, Palm Charters, LLC, and Tradewinds Yacht & Ship, LLC may bid a credit against the custodial costs relating to the arrest and custody of the White Motor Vessel at such sale, as authorized by the Court (Dkt No. 113), adjusted to the date of sale, without tender of cash.
     The person whose bid is accepted shall immediately pay the Marshal the full purchase price if the bid is $1000 or less. If the bid exceeds $1000, the bidder shall immediately pay deposit of at least $1000 or 10% of the bid, whichever is greater, and shall pay the balance within 3 cou11 days after the day on which the bid was accepted. If an objection to the sale is filed within that 3 court day period, the bidder is excused from paying the balance for the purchase price until 3 court days after the sale is confirmed. Payment shall be made in cash, by certified check, or by cashier’s check. Written bids can be made with a deposit of 30% of the bid.
